By accessing or using this platform ("Platform"), you agree to comply with and be bound by these terms of use ("Terms of Use"). If you do not agree, please refrain from using and exit the Platform.

The Platform facilitates professional guidance from expert doctors ("Experts") to the fellow doctors ("Users") regarding patient case histories under treatment. The Platform is intended solely for professional medical collaboration and not for direct patient consultation. Use does not create a doctor-patient relationship.

Eligibility To be able to avail any of the services offered by us,

• Only licensed medical practitioners are permitted to register and use the Platform. The Platform assumes no obligation to verify credentials. Users must provide accurate credentials maintain compliance with applicable laws.
• You need to be competent to contract as per the Indian Contract Act, 1872.
• Further you confirm that any court, tribunal or any adept authority does not prohibit or impose any kind of restriction/conditions/order to accept the Terms of Use or online services of nature and function similar to ours.
• You also confirm that you are not violating any applicable law by accepting the Terms of Use.
• We reserve the right to terminate your services and refuse to provide access to the Platform at our sole discretion, including in case of any such violation.

• As a registered User you are responsible for maintaining the confidentiality of your Registered Account and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur due to your use or under your account or Password.
• Services as a registered User are available to you only if you provide required personal information in the registration form to the Platform.
• Further, you agree:
  • To protect against wrongful access to your account (e.g., use a strong password and keep it confidential); (2) not share or transfer your account or any part of it (e.g., sell or transfer the personal data of others by transferring your connections); and (3) follow the law, and Terms of Use. You are responsible for anything that happens through your account even after you close it or report misuse.
• To provide true, accurate, current and complete information about yourself in the registration form (such information being the "Registration Data") and regularly maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
• To use the services only for the purpose that are permitted by the aforesaid Terms of Use and any applicable law, regulation or binding medical guidelines in the relevant jurisdiction.
• That you will be solely responsible for any breach of your obligations under the Terms of Use and for the consequence of any such breach, including any loss or damage, which we may suffer as a and that the Platform disclaims all liability to you or to any third party.
• That your account and the activity under it are subject to review from time to time by us.
• Your account or access to any services or products may be blocked or may become subject of deletion if found to be objectionable, obscene or offensive, without any prior notice to you.
• That you agree that you will not solicit passwords or personal identifying information for any purposes from other accounts or try to hack into the server in any manner.

You agree that we will provide notices and messages to you at the contact information, you provided us.(e.g., email, mobile number, physical address), and such notices shall be deemed delivered upon dispatch. You agree to keep your contact information up to date.

You further agree not to host, display, upload, modify, publish, transmit, update or share any information that belongs to another person and to which the User does not have any right to, unless you have written consent from the owner the Platform; is unlawful, tortious, harassing, blasphemous defamatory, obscene, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; is offensive or menacing in nature; violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;

This PLATFORM AND ITS AFFILIATES MAKE NO REPRESENTATION OR WARRANTY ABOUT THE SERVICES, INCLUDING ANY REPRESENTATION THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND PROVIDE THE SERVICES (INCLUDING CONTENT, OUTPUT AND INFORMATION) ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, PLATFORM AND ITS AFFILIATES DISCLAIM ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

You expressly understand and agree that the Platform, its operators, subsidiaries, affiliates, directors, officers, employees, agents and representatives shall not be liable to you or any third person for any direct, indirect, incidental, special, consequential punitive or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other tangible or intangible losses, resulting from, arising out of, or in any way related to:

• the use of, or the inability to use the service;
• any data, information, guidance, recommendations, content or services availed through or from the Platform;
• any messages received or transactions entered into through or from the Platform;
• reliance on any guidance, recommendations, information, or content provided through the Platform, including any resulting clinical outcomes;
• unauthorized access to, use of, or alteration of your transmissions or data;
• any statements, actions, or conduct of any third party on or through the Platform;
• the deletion of, corruption of, or failure to store any content or communications data maintained or transmitted by or through your use of the services; or
• any other matter relating to the Platform or the Services.

This limitation of liability shall apply to the fullest extent permitted by applicable law.

• The Platform is provided on an 'as is' basis without guarantees against errors.. Any mistake, error or discrepancy noted may be brought to our notice for our review without any obligation to rectify. It is notified that neither Platform nor the authors nor the publishers will be responsible for any damage or cause of action to any one of any kind, in any manner, therefrom.
• The guidance provided by Experts is strictly advisory in nature, does not constitute medical diagnosis, and based on the information shared by Users.
• Users remain fully responsible for all clinical decisions, patient care, and compliance with local medical regulations.
• The Platform does not replace independent medical judgment.

The services provided at Platform are free of charge for the time being. The right to levy / revise the fees or charges at any time is reserved by us.

Any such levy or change will be binding and effective immediately on posting of the revision at the platform unless you terminate your account immediately.

Users must ensure that any patient information shared complies with applicable privacy laws (e.g., HIPAA, GDPR, or local equivalents). Personally identifiable information must be strictly anonymized before uploading.

Users shall not:

• Share false or misleading information.
• Use the Platform for emergency medical advice.
• Engage in any activity that violates laws or professional ethics.

All content, data uploaded, opinion shared, documents uploaded, trademarks, and technology on the Platform are owned by or licensed to the Platform operator. Unauthorized use is prohibited.

The Platform reserves the right to suspend or terminate access at its sole discretion, with or without cause.

The Platform is not responsible for delays, failures, or service disruptions caused by events outside its reasonable control, such as natural disasters, pandemics, government actions, wars, strikes, internet or power failures, or similar unforeseeable events (Force Majeure). If such an event occurs, the Platform will inform users, try to reduce the impact, and resume services as soon as reasonably possible. If the situation lasts more than 30 days, the Platform may suspend or terminate affected services without liability. During the event, the Platform's obligations are paused, but users must still comply with the law and the Terms. This clause is governed by Indian law and may be updated to reflect legal changes.

These Terms of Use are governed by Indian law. Any disputes related to the Terms must be handled exclusively by the courts located Mumbai.

If a dispute arises, both sides must first try to resolve it through goodfaith negotiations within 30 days of written notice. If that fails, the dispute will be settled by binding Arbitration under Indian Arbitration and Conciliation Act, 1996, conducted by a single Arbitrator chosen by the Platform, in a specified city in India, and in English. The Arbitrator's decision is final. The Platform can still approach courts for urgent or interim relief to protect its rights or confidential information. Arbitration costs shall be borne by the Parties equally.

We may modify this Terms of Use from time to time. If we make any changes to these terms or if we are legally required to provide notice, we will provide you notice through other means, to provide you the opportunity to review the changes before they become effective. However, we may not always provide prior notice of changes to these terms (1) when those changes are legally required to be implemented with immediate effect, or (2) when those changes relate to a newly launched service or feature. Changes will apply prospectively unless legally required otherwise.. If you object to any of these changes, you may close your account. Your continued use of our Terms of Use after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.

• The Platform is not a substitute for direct patient care or emergency medical services.
• Guidance provided is based on limited information and should be used as supporting advice only.
• The Platform does not guarantee accuracy, completeness, or suitability of any guidance.
• Users are solely responsible for verifying information and making independent clinical decisions.
• The Platform and its operators disclaim all warranties, express or implied, including fitness for a particular purpose.

All data including your or third party personal data are stored and accessed by the Platform you're your expressed valid consent (the genuineness is proved by accepting the Terms of Use) and that it may be used, processed, or stored by the Platform or by its third party agents as per the Platform's sole discretion.

You also understand that you have the right to revoke your consent at any time by providing a written notice to the Platform, however, such revocation shall not affect the lawful processing conducted prior to such revocation.
